Welcome to the new site Whoosh Gone. We are here to provide a buying and selling service online and worldwide.  These terms and condition are for the service from whooshgone.co.uk. You are agreeing to the terms and conditions written for UK based buyer and sellers.

 

Using Whoosh gone

You can only use this site if you are 18 or old because you can’t agree to a legal contract between yourself and Whoosh Gone.

When using Whoosh gone you agree not to upload any items that are inappropriate or illegal to sell.

If you do sell any illegal product, you will be suspended from Whoosh Gone services or even block from using are site again.

You can start using are Whoosh Gone services as soon as you agree to all are terms and condition.

Unless we agree otherwise, you not be able to cancel this Agreement under the Consumer Protection Regulations 2000 once the supply of this service has started.

We will also remove an account if it has been inactive for more than 18 months.

 

Misusing Whoosh Gone

If we find you are not using Whoosh Gone correctly and selling inappropriate items and illegal item we will suspend your account and if you continue to misuse Whoosh Gone’s services we will remove your account.

We will send you warning or make you relist items if you have described them to mislead people or you are trying to copyright items.

You also agree not to hold Whoosh gone responsible for any losses from us removing any of your items.

Whoosh Gone Buyer

If you find a problem with an item you have purchase through Whoosh gone services we would recommend you contact to seller to see if you can come to an agreement first before you contact us to see if you can resolve the issue. But you must make sure you have contacted use within the 7days of paying for the item because after that time we process your money and it will be sent to the seller. If in that case you have failed to contact us, you can still get in touch and we will try are best to resolve the issue. But if you have left good grade to the sell we can’t help you because you have accept that the item was correct and was delivered in correct time and was how it was describe in the listing.

Buyers Behaviour: buyers are expected to act with honesty and integrity in their business dealings with their sellers and with Whoosh Gone. It is not permitted for buyer to make purchases where there is no intention to make a payment. Buyers should agree to payment conditions that are laid down in the sellers listing description. It is not permitted to threaten, bully, coerce or use profane language with the seller or with Whoosh Gone’s staff.  It is not permitted for buyers to encourage sellers to break the law, and any such incidence suspected by Whoosh Gone will be reported to the relevant authorities. Buyers should use their feedback of sellers responsibly and appropriately. It is no defence for a buyer to claim ignorance of these rules.

 

Copyright breaches: Where a buyer suspects a copyright breach to have taken place, it should be reported to Whoosh Gone immediately in the first instance so that the breach can be evaluated and acted upon. Copyright breach is taken seriously by Whoosh Gone and will lead to account suspension or permanent exclusion where proven against the seller. Equally, false claims from buyers – where it is judged as malicious, deliberate and planned - will be treated seriously by Whoosh Gone and will similarly lead to account suspension or permanent exclusion of the buyer.

 

 

Breaches of Whoosh Gone terms and conditions, or any other policy or procedure in force can result in a range of actions, including:

 

 

·         Limits on account privileges

 

·         Account suspension

 

·         Permanent exclusion

 

 

Payment

 

Payment: For goods and services provided through Whoosh Gone, the Customer shall settle all the invoice(s). For goods that are ordered via the Sites and procedures for payment are provided on the Site the Customer shall pay by credit or debit card. When paying by credit or debit card, the Customer warrants that the card is his (or her or its) own and that there are sufficient funds or credit facilities available to pay for the Goods. The Company reserves the right to verify or validate the Customers' debit or credit card details before providing Products or Services. Time for payment shall be of the essence.

 

Payment for items must be made within 48hr of winning the auction and also if you buy a buy now item. If payment is not completed within the time limit you must contact the seller and explain your reason. If it is for lack of funds you will be suspended for 1 week as you should not bid or commit to buy an item without funds to pay for it. If you need more time to pay for the item you must contact the seller before you bid or confirm to buy the item.

 

 

 

 

 

Shipping & Postage

Shipping and Postage is not responsible by Whoosh Gone. It is set by the seller whom has to post the time within his time there time limit. Postage can be slow due to weather conditions and other unseen events. If an item is undelivered you must leave negative review within 7days otherwise we cannot retrieve the payment without going through are complains department.

 

 

 

 

Reviewing Items

You must reply or leave a negative review if the item is not up to standard or damage. After 7days the payment will be passed on to the seller(s) if you have not left a negative review. It’s important that you contact the seller and Whoosh Gone if the item is not delivery within the delivery time limit.

Reviewing is important to seller as it shows how trust worthy they are and gives other buyers confidents to buy from them. So we highly recommend you leave a review. It’s so easy to review with us it won’t take a min with are grade rating system.

Selling:

 

 

• What can be sold: Whoosh Gone is a site for selling/ auctioning general products. Whoosh Gone retains the ultimate right to adjudicate on such matters where this is desirable. Certain items will be prohibited or may have certain restrictions applied – these include illegal goods and services, and the sale of controversial or sensitive items that Whoosh Gone believes may compromise the integrity of its buying and selling environment. A prohibited item can be an illegal, untrustworthy or harmful item that is likely to pose a high risk to the reputation and credibility of Whoosh Gone. Sellers are advised to consult the Prohibition List before listing an item.

   

 

• Listing Practices: Sellers are not allowed to use profanity, html, JavaScript or hyperlinks in their item listing. Misuse of intellectual copyright (including the inclusion of brand names) or misrepresentation of products listed for the purpose of attracting buyers (e.g. misleading descriptions, false endorsements, unsubstantiated claims, etc) is strictly prohibited. Sellers are advised to consult the Copyright Guidance for further information on product listing and representation. No circumvention of Whoosh Gone fees is permitted and sellers are referred to the Fees & Tariffs Guidance for further advice. Membership of the Whoosh Gone community assumes that these rules are understood and complied with. It is no defence for a seller to claim ignorance of these rules.

   

 

• Completing the sale: Sellers must not accept payment and send an item that is significantly different from the item described in the listing. A feedback system is operated for all sellers and is designed to protect the integrity of the buyer-seller relationship. There is no force outside Whoosh Gone that may determine whether feedback is appropriate and just, and all matters of issue in respect of seller feedback must be made through Whoosh Gone complaints resolution process. Sellers should identify genuine shipping costs and despatch times, and must not deviate from these once listed. A seller enters into a binding contract with the buyer when there is a completion of sale and is expected to honour what is offered in the product listing.

·         Forfeit of Whoosh Gone fees on cancelled listings

 

·         Limits on account privileges

 

·         Account suspension

 

·         Permanent exclusion

 

 

 

 

When breaches of policy occur, Whoosh Gone will email the seller, as well as bidders, that a listing has been ended. These terms and conditions are periodically updated in line with current market, company or legal developments.

 

Payments

 

All payments must be made though Whoosh Gone payment system. If an item is paid for in any other way it will not be coved by Whoosh Gone and if any losses occur we will not be responsible. All items that are purchased on Whoosh Gone must be paid in full to be covered by Whoosh Gone.

 

Costs

 

Joining Whoosh Gone is free and it is also free to bid on items too. We also don’t charge to use other services like selling an item on are site. The only charges that apply are the ones listed below:

 

We only take a percentage from the end sale price.

 

 This will be 2.5%. For example:

 

So if an item sells for £10.00 and it costs £4.00 to post, Whoosh Gone will take £0.35 for the total combined price.  So the amount passed on to you will be £13.65.

 

We take a percentage of the total end amount.

 

We may choose to change to change are cost in the future but we will make a public notice on are news letter to allow everyone to know what we have change.

 

If you don’t settle all your outstanding payments, we may collect the money owed us by charging you in using normally free service. You also agree to having all invoice sent to you by email from both Whoosh Gone and Whoosh Gone Shops.

 

Any losses that occur to both buyers and sellers can’t be held against Whoosh Gone.

 

Please don’t think that because an item is sold on are site it means that it is legal or valid.

 

You accept all responsibility for the legality of your actions under laws that apply to you and the legality of any of the items listed on Whoosh Gones site.

 

 

Payment: For goods and services provided through Whoosh Gone the Customer shall r settle all the Company's invoice(s) including VAT and delivery charges in full, without any deduction or set-off within 30 days of the date of the Company's invoice or if Products or Services are ordered via the Sites and procedures for payment are provided on the Site the Customer shall pay by credit or debit card. If paying by credit or debit card, the Customer warrants that the card is his (or her or its) own and that there are sufficient funds or credit facilities available to pay for the Products or Services. The Company reserves the right to verify or validate the Customers' debit or credit card details before providing Products or Services. Time for payment shall be of the essence.
